By accessing or using this website, you agree to these Terms. If you do not agree with them, please do not use the website.

Botes & Co. is a founder-led marketing strategy practice operated from Dubai, United Arab Emirates.

Botes & Co. provides marketing strategy, positioning, go-to-market, fractional marketing leadership, marketing orchestration and related consulting services.

Botes & Co. may also use proprietary technology, automation and artificial-intelligence-assisted tools, including the Botes & Co. Control Room, to support client engagements.

These Terms apply to use of the website and publicly available digital services.

They do not replace a separate consulting agreement, proposal, statement of work or other commercial agreement entered into between Botes & Co. and a client.

Where a separate client agreement exists, that agreement will govern the relevant engagement.

You may use this website for lawful business and informational purposes.

Consulting engagements

The existence of this website does not create a client relationship.

A consulting relationship begins only when Botes & Co. and the relevant client agree to an engagement through an appropriate written agreement, proposal, statement of work or other confirmation.

Client engagements may specify:

  • confidentiality

Botes & Co. Control Room

The Botes & Co. Control Room is an internal marketing intelligence and execution system used to support Botes & Co. client engagements.

Where authorised by a client, the Control Room may connect to selected advertising, analytics, marketing or business platforms.

It may assist with:

  • retrieving authorised performance data
  • analysing results
  • identifying issues or opportunities
  • preparing recommendations
  • monitoring campaigns
  • supporting reporting
  • implementing actions authorised by the client
  • verifying whether approved changes had the intended effect

Intended operating model

Analyse → Recommend → Human Approval → Execute → Verify

Technology supports professional judgement. It does not replace it.

Artificial intelligence and automation

Botes & Co. may use artificial intelligence, automation and other technology to support its work.

These tools may assist with:

  • research
  • analysis
  • diagnostics
  • pattern detection
  • drafting
  • reporting
  • recommendation development
  • operational execution

AI-generated or automated outputs may contain errors, omissions or limitations.

Botes & Co. therefore applies human review where appropriate and does not treat automated output as infallible.

Material strategy and client decisions remain subject to professional judgement and applicable approval controls.

Client approvals and authority

Where Botes & Co. is authorised to manage or support advertising, analytics or other client systems, the client is responsible for ensuring that it has the necessary authority to provide Botes & Co. with access.

Clients remain responsible for:

  • the accuracy of information they provide
  • ensuring they have rights to data and systems they authorise Botes & Co. to access
  • maintaining appropriate internal approval authority
  • reviewing material recommendations where approval is required
  • ensuring budgets and financial limits are correctly communicated

Botes & Co. will not knowingly access a client platform without appropriate authority.

Third-party platforms

Botes & Co. may work with third-party services including advertising, analytics, technology, communications, AI and cloud platforms.

These may include services provided by organisations such as Google, Microsoft, Meta, LinkedIn or other technology providers.

Those services are governed by their own terms, policies and availability.

Botes & Co. does not control and is not responsible for:

  • third-party outages
  • account suspensions
  • platform bugs
  • API changes
  • algorithm changes
  • policy changes
  • reporting delays
  • inaccurate third-party data
  • changes to platform functionality
  • actions taken directly by third-party providers

Where third-party platform changes materially affect an engagement, Botes & Co. may adapt its approach accordingly.

Advertising spend and external costs

Unless otherwise agreed in writing, advertising spend, media budgets and external platform charges are separate from Botes & Co. consulting fees.

Clients are responsible for authorised third-party charges associated with their accounts.

Where Botes & Co. manages or advises on media spend, budgets and approval limits should be agreed as part of the relevant client engagement.

Intellectual property

Unless otherwise stated, the Botes & Co. website and its original content are owned by or licensed to Botes & Co.

This includes, where applicable:

  • website copy
  • visual design
  • branding
  • strategic frameworks
  • methodologies
  • templates
  • written materials
  • diagrams
  • processes
  • Control Room technology
  • internal tools
  • proprietary workflows
  • original research or analysis

You may view and share links to publicly available website content for legitimate purposes.

You may not reproduce, republish, sell, commercially exploit or materially adapt Botes & Co. intellectual property without written permission.

Client intellectual property and data

Clients retain ownership of their own:

  • brands
  • trademarks
  • business information
  • customer information
  • advertising accounts
  • analytics properties
  • source materials
  • proprietary data

Ownership of deliverables created during a consulting engagement will be governed by the applicable client agreement.

Botes & Co. does not claim ownership of a client's underlying business data simply because it is processed through the Control Room or another authorised system.

Case studies and references

Botes & Co. may refer to selected work, strategic thinking or client engagements on the website or in marketing materials where permitted.

Confidential or commercially sensitive information will not knowingly be disclosed without appropriate permission.

Where required, client names, metrics or identifying information may be withheld, aggregated or anonymised.

Information shared through a genuine client engagement may be subject to confidentiality obligations contained in the relevant client agreement.

Visitors should not submit highly confidential, sensitive or proprietary information through a general website contact form unless specifically requested.

Availability of the website

However, we do not guarantee uninterrupted or error-free access.

  • failures of third-party platforms or services

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

Specific liability arrangements relating to client consulting services will be governed by the relevant client agreement.

Your continued use of the website after a change means the updated Terms will apply to subsequent use.

Governing law

Unless another agreement states otherwise, these Terms are governed by the applicable laws of the United Arab Emirates.

Any dispute relating solely to use of this website will be subject to the jurisdiction of the competent courts in Dubai, United Arab Emirates, unless applicable law requires otherwise.

Separate client agreements may specify different dispute-resolution or governing-law provisions.
